Terms of Use

Operating entity: Domainity.App, LLC, a Georgia limited liability company. Governing law: State of Georgia, USA. Jurisdiction-specific notes are called out separately below.

1. Informational Purposes Only

Domainity ("the App," "we," "us") provides domain name research and analytics tools intended solely to assist users in organizing publicly available information for their own independent evaluation. The App does not provide legal, financial, investment, tax, or professional advice of any kind. Nothing generated by the App — including any finding, alert, outcome band, or report — constitutes a recommendation to buy, sell, hold, or avoid any domain name, and should not be relied upon as the sole basis for any transaction or financial decision.

The App deliberately does not issue "go" or "do not buy" verdicts. It reports what its data sources returned, identifies what it could not check, and leaves the decision to you.

2. No Professional Relationship

Use of the App does not create an attorney-client, fiduciary, advisory, or other professional relationship between you and Domainity, its owners, employees, or affiliates.

3. Third-Party Data Sources

The App aggregates and displays data obtained from third-party sources, which may include WHOIS and DNS registries, trademark databases, web archive services, threat-intelligence and blacklist providers, and domain valuation services (collectively, "Third-Party Data"). Regarding Third-Party Data, Domainity expressly disclaims:

• Any warranty as to the accuracy, completeness, timeliness, or reliability of Third-Party Data;
• Any responsibility for errors, omissions, gaps in coverage, or classification mistakes originating from a third-party provider;
• Any obligation to verify, audit, or correct Third-Party Data before display;
• Any endorsement of, or affiliation with, the third-party providers themselves.

Known limitations, disclosed for transparency and not as an exhaustive list:

• Trademark screening reflects United States federal registrations only. It does not cover state, common-law, or international trademark rights. The App performs string matching against registered marks and reports what it finds, including the classes in which those marks are registered. It does not assess likelihood of confusion, class overlap with your intended use, dilution, or any other question of trademark law. A domain with no match is not cleared for use; a domain with matches is not necessarily unavailable to you. Those determinations require an attorney.
• Archived content history is reported as the presence, count, and date range of captures held by a third-party web archive, together with a link to that archive. The App does not retrieve, analyze, or classify the content of archived pages, and therefore makes no assessment of whether a domain previously hosted adult, pharmaceutical, gambling, malware, or any other category of content. Archive coverage is incomplete and varies by domain.
• Blacklist and reputation checks reflect specific named sources at the moment of the query. The absence of a listing is not evidence that a domain is safe, only that the queried sources did not list it at that time. Listings can appear or disappear at any time, and no source covers all malicious activity.
• WHOIS and DNS data availability varies by TLD and registrar. Registrant identity is redacted by most registries under privacy regulations, so ownership history in practice reflects registrar and nameserver changes rather than named parties.
• Domain valuation figures, where shown, are third-party estimates. They are frequently inconsistent with each other and with eventual sale prices, and are displayed side by side without synthesis into a single "correct" value. Where a source publishes upper-percentile outcomes, those are labelled as best-case scenarios and are not expected values.

4. Findings, Bands, and Coverage Are Not a Guarantee

The App reports individual findings from each check and summarizes them into a coarse outcome band. These are summaries of available signals at a point in time. They are not a certification, guarantee, appraisal, legal clearance, or warranty that a domain is free of risk, dispute, infringement claims, blacklisting, or any other issue.

A result indicating no adverse findings does not mean a domain is risk-free, and a result indicating concerns does not mean a domain cannot be safely acquired. Users must exercise independent judgment.

Incomplete results. Where a data source is unavailable, rate-limited, or does not cover a domain, the App marks that check as unavailable and says so in the report. An incomplete result is not a clean result. Users should not treat the absence of a finding from an unavailable check as evidence that no such finding exists.

5. User Responsibility

You are solely responsible for conducting your own due diligence, including consulting a qualified attorney for trademark or legal risk assessment, before acquiring, selling, or otherwise transacting in any domain name. You assume all risk associated with decisions made in reliance on information provided by the App.

6. No Warranty ("As Is" / "As Available")

THE APP AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED/ERROR-FREE OPERATION.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Domainity.App, LLC, its owners, members, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunity, arising from or related to your use of (or inability to use) the App, even if advised of the possibility of such damages. To the extent any liability cannot be excluded, Domainity's total aggregate liability for any claim shall not exceed the amount you paid for your subscription in the twelve (12) months preceding the claim.

8. Indemnification

You agree to indemnify and hold harmless Domainity.App, LLC and its owners, employees, and affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the App, your violation of these terms, or your reliance on information provided by the App in connection with any domain transaction.

9. Governing Law and Dispute Resolution

These terms are governed by the laws of the State of Georgia, USA, without regard to conflict-of-law principles. Any dispute arising from these terms or use of the App shall be resolved through binding individual arbitration administered under the rules of the American Arbitration Association, and you waive any right to participate in a class action or class arbitration. *(Note: arbitration/class-action-waiver clauses are a standard litigation-reduction tool but are unenforceable against consumers in some jurisdictions — e.g., parts of the EU — see carve-outs below.)*

10. Jurisdiction-Specific Notes

• European Union / UK (GDPR): If you are located in the EEA or UK, mandatory consumer-protection and data-protection rights under GDPR/UK GDPR apply regardless of the governing-law clause above and cannot be waived. See the companion Privacy Policy for lawful basis, data subject rights, and transfer safeguards.
• California (CCPA/CPRA): California residents retain statutory rights regarding personal information that this disclaimer does not limit.
• Australia (Australian Consumer Law): Certain consumer guarantees under the ACL cannot be excluded; nothing in this disclaimer is intended to exclude, restrict, or modify any such non-excludable right.
• General: Where mandatory local consumer-protection law conflicts with any provision above, the local law governs solely to the extent of the conflict, and the remainder of these terms remains in effect.

11. Severability

If any provision of this disclaimer is found unenforceable, the remaining provisions remain in full force and effect.

12. Changes to This Disclaimer

Domainity.App, LLC may update this disclaimer from time to time. Continued use of the App after changes constitutes acceptance of the revised terms.
